This is about whether the jury should have been able to hear more evidence that was left out by prior counsel. -Justin McShane
A man convicted in a 1996 murder case is pointing the finger at another man – and asking for a new trial.
Tyshaunt Love was convicted of third-degree murder and got a prison sentence of 15 to 30 years for killing his former girlfriend, 20-year-old Iris Fennell Belcher. Police said she was shot twice and beaten.
Love was convicted nine years after the crime. But his lawyer says the jury didn’t hear from three different prison inmates – who said another man did it.
Those inmates claim that Laqun Williams confessed to killing Fennell. Williams is serving time for a rape conviction. Prosecutors say those jailhouse snitches aren’t credible witnesses. But Love’s lawyer disagrees and says his client deserves a new trial.
*”I have a specific job here today to get this man a new trial if it’s warranted, and I believe it is in this particular case,” said Justin McShane, Love’s attorney. “This isn’t about whether or not he did it. This is about whether the jury should have been able to hear more evidence that was left out by prior counsel.”*
“I’ve worked this case frontwards and backwards,” said prosecutor Sean McCormack. “I’ve seen every statement in this case, every piece of evidence in this case and everything leads me to conclude that Tyshaunt Love is the man who pulled the trigger and killed Iris Fennell.”
There’s no ruling yet on whether Love gets a new trial because the hearing isn’t over yet.
