If you’re pulled over for suspected DUI in Pennsylvania, what happens next can shape your entire case. Understanding what to expect during a DUI traffic stop can help you stay calm, protect your rights, and avoid making things worse.
The Stop
Most DUI traffic stops begin with a simple traffic violation—like swerving, speeding, or a broken tail light. Once the officer approaches your vehicle, they’ll look for signs of impairment: slurred speech, bloodshot eyes, alcohol odor, or confusion.
Field Sobriety Tests (FSTs)
If the officer suspects you’re impaired, they may ask you to perform FSTs—like walking in a straight line or standing on one leg. These tests are voluntary, and poor performance can be used against you.
Portable Breath Test (PBT)
The officer may request a roadside breath test. This is also voluntary and not the official breathalyzer used at the station. Refusing it may raise suspicion but won’t carry automatic penalties like refusing the official test.
The Arrest
If the officer believes there is probable cause, you’ll be placed under arrest and taken to a hospital or police station for a chemical test (breath or blood).
Know Your Rights
You have the right to remain silent and the right to an attorney. Exercise them. Don’t explain, don’t argue, and don’t volunteer information.
