Shining a Light on Flaws in the Criminal Justice System: The Need for Ongoing Reform

Introduction:

In a powerful moment, rapper Meek Mill stood alongside Pennsylvania Governor Josh Shapiro as he signed a bill reforming probation into law. This emotional event highlighted the experiences of individuals like Meek Mill, who have faced the harsh realities of our criminal justice system. While the recent reform is a step in the right direction, it’s clear that there are major flaws in our criminal justice system that demand further reform and attention. At The McShane Firm, we believe in advocating for justice and equity within the legal system.

A Positive Step:

The newly signed bill brings about significant changes to Pennsylvania’s probation system. It introduces mandatory probation reviews after two years or 50 percent of a misdemeanor sentence, whichever is shorter. For felony probation, the same reviews are required after four years or 50 percent of the sentence. These reviews ensure that individuals are not subjected to extended periods of probation without a thorough assessment of their progress.

Furthermore, the bill clarifies to judges that minor technical violations of parole agreements should not result in individuals being sent back to jail. This includes non-serious infractions like being late to appointments, returning home after curfew, or visiting family out of state without permission. Confinement should only be used for “serious” violations or individuals considered a threat to public safety.

The Light Shone on Injustices:

Meek Mill’s case played a pivotal role in bringing about these reforms. His experience highlighted the injustices within the probation system, where individuals could be sentenced to prison for minor technical violations rather than actual crimes. It’s a stark reminder of the need for a fair and just probation system that prioritizes rehabilitation over punishment.

Automatic Clearing of Criminal Records:

In addition to probation reform, Governor Shapiro also signed a bill that automatically clears the criminal records of those who are pardoned. This is another positive step towards giving individuals a fresh start after paying their debt to society.

Expanding the Sealing of Convictions:

Furthermore, another bill was signed to expand the types of convictions eligible to be sealed from public view, including minor drug felonies. This change acknowledges that individuals can change and grow over time, and their past should not continue to define their future.

The Road to Reform Continues:

While these reforms are commendable, there is still much work to be done in the realm of criminal justice reform. We must continue to address the flaws in our system, advocate for equitable treatment, and provide opportunities for individuals to rebuild their lives after involvement with the criminal justice system.

Conclusion:

Meek Mill’s journey and the recent legislative changes in Pennsylvania have shed light on the major flaws within our criminal justice system. While we celebrate the progress made, we must also acknowledge that more reform is needed to ensure that justice is served and that individuals are not unfairly punished for minor violations. At The McShane Firm, we stand in support of ongoing efforts to create a more just and equitable legal system for all.
