PFA-Related Firearm Possession in Lancaster County: One Violation, One Felony

In Lancaster County, if you’re under a Protection from Abuse (PFA) order and are found possessing a firearm, you can be charged under 18 Pa.C.S. § 6105(a.1). This is a felony of the second degree, even if the firearm was never used or displayed.

What the Law Says:

Once a PFA is issued and includes a firearm prohibition, you must surrender all weapons immediately. You cannot:

  • Keep a gun in your home
  • Possess a gun at work
  • Use someone else’s firearm for any purpose

Penalties:

  • Felony of the second degree
  • Up to 10 years in prison
  • Up to $25,000 in fines
  • Permanent firearm disability

Local Application:

Lancaster County judges issue PFAs regularly, and the Sheriff’s Office enforces them swiftly. If your ex claims you still have a weapon, expect immediate police involvement.

How We Defend You:

We question whether you were properly served, whether the firearm was actually surrendered, and whether it was in your possession at all. Often, people aren’t aware the PFA includes gun restrictions, especially in emergency orders.
