Retail Theft in Pennsylvania: What You’re Really Facing

Retail theft—often called shoplifting—is more than just a minor mistake in Pennsylvania. A conviction can lead to serious legal consequences and a permanent mark on your record.

What Counts as Retail Theft?
Under 18 Pa.C.S. § 3929, retail theft includes more than just walking out without paying. It also covers:

  • Switching or altering price tags
  • Transferring items into different packaging
  • Under-ringing items at checkout
  • Removing anti-theft devices
All of these show intent to avoid paying full value—and that’s enough to get charged.

Penalties Based on Value and Prior Offenses:

  • First Offense (< $150): Summary offense, up to 90 days in jail, $300 fine
  • Second Offense or $150–$999: M2, up to 2 years in jail, $5,000 fine
  • Third Offense or > $1,000: M1, up to 5 years in jail, $10,000 fine
  • Felony Retail Theft (Value > $2,000 or 3rd+ offense): F3, up to 7 years in jail, $15,000 fine

Why It Matters
A retail theft conviction can affect your job prospects, education, and even housing. It’s not just about jail—it’s about your future.
