Penalties for Driving Under Suspension Due to DUI in Pennsylvania

Driving on a suspended license is bad enough. But if that suspension stems from a prior DUI, the penalties in Pennsylvania get much more serious—fast.

First Offense (No Alcohol in System):
 Even without alcohol in your system, you face a summary offense, a $500 fine, 60–90 days in jail, and an additional 1-year suspension.

Second Offense (No Alcohol in System):
 The fine doubles to $1,000, and you’re looking at a minimum of 90 days in jail, plus another 1-year license suspension.

Third or More (No Alcohol):
 This becomes a misdemeanor of the third degree, with six months in jail, a $2,500 fine, and another year tacked onto your suspension.

With BAC of 0.02% or Above (Any Offense):
 This is treated more harshly. You’ll face 90 days in jail, a $1,000 fine, and a 2-year license suspension.

Repeat Alcohol-Related DUS Offenses:

  • Second Alcohol Violation: 3rd-degree misdemeanor, 6 months in jail, $2,500 fine, 2-year suspension.
  • Third Alcohol Violation: 1st-degree misdemeanor, 2–5 years in jail, $5,000 fine, 2-year suspension.
