In Pennsylvania, probation is a form of supervision that allows individuals who have been convicted of a crime to serve their sentence outside of prison or jail, while still being held accountable to the court and the community.
During probation, individuals are typically required to follow certain conditions set by the court, such as:
- Reporting to a probation officer on a regular basis
- Abiding by a curfew
- Maintaining employment or seeking employment which may include a probation and parole officer to visit your work or talk to your boss
- Completing community service
- Paying restitution or fines
- Not committing any additional crimes
- Not possessing any firearms or dangerous weapons
- Not associating with certain individuals determined by the court
- Not possessing or using drugs or alcohol which can include random drug and alcohol tests
- Participating in counseling or treatment programs, if required
Probation in Pennsylvania typically usually last from one to five years or in some cases much longer. The length and terms of probation and parole are negotiable by your attorney. That is why it is important to have a good attorney on your side even if you want to just plead guilty.
If the individual is found to have violated any of the conditions of their probation, the court may revoke probation and impose a much harsher and longer sentence. This can include prolonged jail time. You will definitely need an attorney if there is an alleged probation violation because a lot will be on the line.
Probation officers are responsible for monitoring the individuals on probation and ensuring they are complying with the conditions set by the court. Some are understanding. Many are not.
